Tulsa Rig Iron, Inc. warrants that for a period of 6 months from the date
of invoice, equipment of Tulsa Rig Iron manufacture, (the “Equipment”)
shall be free of defects in materials and workmanship under normal use
and service. This is provided the Equipment is used and maintained in
accordance with industry standards.
If a defect in Equipment appears within 6 months from the date of
shipment, and purchaser has given written notice of such defect within
ten (10) days from a discovery thereof, Tulsa Rig Iron will repair or
replace the part, at its option ship a similar part F.O.B. shipping point.
Or at its option, refund an equitable portion of the purchase price.
Tulsa Rig Iron may require the return of the defective part, to a
designated place, freight prepaid to establish purchaser’s claim.
No allowance will be made for repairs undertaken without Tulsa
Rig Irons written approval.
This warranty applies only to the equipment manufactured by Tulsa
Rig Iron, Inc. Warranties on components manufactured by others,
if any, are hereby assigned to the purchaser at the time of delivery.
Any description of the equipment, drawings, specifications used in
connection with this sale are for the sole purpose of identifying the
equipment and are not to be construed as an expressed warranty
that the equipment will conform to such description.
The foregoing warranties are in lieu of all other warranties, whether
oral, written, expressed, implied or statutory. Implied warranties of
merchantability and fitness for a particular purpose will not apply.
Tulsa Rig Iron’s warranty obligations and purchaser’s remedies
hereunder are solely and exclusively as stated herein.
Purchaser’s sole and exclusive remedy, whether based upon warranty,
contract or tort, including negligence will be to proceed under this warranty.
All liability of Tulsa Rig Iron, Inc. shall terminate six months from the date
of delivery of the equipment.
Company, its suppliers, and its distributors shall in no event be liable to the
user, any successors in interest or any beneficiary or assignee relating to the
sale of this sale for any consequential, incidental, indirect, special or punitive
damages arising out of this sale or any breach thereof, or any defects in, or
failure of, or malfunction of the equipment under this sale whether based
upon loss of use, lost profits or revenues, interest, lost goodwill, work
stoppage, impairment of other goods, loss by reason of shutdown or
non-operation, increased expenses of operation of equipment, or claims
of user or customers of the user of service interruption whether or not
such loss is based on contract, warranty, negligence, indemnity, strict
liability or otherwise.
